Interpretation and Definitions

Interpretation

The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For this Privacy Policy:

• Account means a unique account created for you to access our Service or parts of our Service.

• App refers to the Build Ezi mobile application available for download on the Apple and Google Play Stores. 

• Company (referred to as “the Company”, “we”, “us” or “our” in this Privacy Policy) refers to BUILD EZI AU PTY LTD (ABN 77 657 772 864, ACN 657 772 864), located at Suite 16, 17 Karp Court Bundall QLD 4217.

• Cookies are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.

• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

• Personal Data is any information that relates to an identified or identifiable individual.

• Service refers to the Website and App and their features, software and business management functions.

• Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

• Usage Data refers to data collected automatically, either generated by the use of our Service or from the Service infrastructure itself (for example, the duration of a page visit).

• Website refers to the Build Ezi website, accessible from www.buildezi.com.

• you or your means the user or individual accessing or using our Service (or the company or other legal entity on behalf of which such a user or individual is accessing or using our Service, as applicable). 

Collecting your data

The data we collect on the Services may be of two types: Personal Data and non-personal data (non-personal data is any data that cannot be used to identify you. This may include anonymous or hashed data). The Personal Data and non-personal data we collect may be classified into and obtained in 3 majors ways described below: 

The Personal Data you submit

While using the Service, we may ask you to provide us with certain Personal Data that can be used to contact, identify you, and comply with the law. You may also willingly provide Personal Data about your clients and employees when you use our templates or schedule tasks and appointments. You may submit Personal Data when you:

• Contact us on the Website or App for support.

• Submit information on the Website to receive information about the App.

• Create an Account on the App.

• Submit your payment method information on the App to subscribe. 

• Fill out the templates and create task schedules.

The Personal Data we collect may include, but are not limited to the following: 

• Email address

• First name and last name

• Phone number

• Payment method data

• Company name and industry

• Names and addresses of clients and employees

The data we collect automatically

We collect the below data automatically through Cookies and other software (described below): 

• Usage Data: Usage Data is collected automatically when using the Service. Usage Data may include information such as the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages and other diagnostic data. 

• Device Data: This refers to data collected about your Device, including your Device type, the IP Address, operating system, browser type, browser version and other Device identifiers. We collect this data automatically when you access the Website and App. 

• Transaction Data: If you subscribe to use the Service, we will collect the details of your transaction, which may include your details, plan subscribed to and related data. 

The data we collect from third-party sources

The App provides you with a feature that allows you to create an Account using Facebook or Google plugins. When you use any of these plugins to create an Account or sign in to use the Services, we will obtain the data you have on the applicable social media platform (subject to your permission settings) to register or sign you in for the Services. 

Your permissions

With your consent and permission, we may request access to certain features on your Device. This may include, without limitation, access to your push notifications and gallery. We require access to enable us to send you notices about your schedules, messages and tasks, and to enable you to import files, such as profile photos, into the App.  

Cookies and Tracking Technologies

We use Cookies and similar tracking technologies to track the activity on the Service and store certain information. Tracking technologies used are Cookies, beacons, tags, and scripts, and we use them to collect and track information and improve and analyze our Service. The technologies we use may include:

• Cookies or browser Cookies. A cookie is a small file we place on your Device when you access the Website in order to gather Usage Data and Device Data. Cookies are used to provide some of the Service features and to identify how the Service is being used. Unless you have adjusted your browser setting so that it will refuse Cookies, our Service may use Cookies.

• Flash Cookies. Certain features of our Service may use local stored objects (or Flash Cookies) to collect and store information about your preferences or your activity on our Service. Flash Cookies are not managed by the same browser settings as those used for Browser Cookies. • Web Beacons. Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

• Persistent and Session Cookies. Persistent Cookies remain on Your personal computer or Device when you go offline. They usually have their assigned expiry dates. Session Cookies, on the other hand, are deleted as soon as you close your web browser. 

• Third-Party Cookies. Most of the Cookies on the Website are set by our Service Providers. They may set their own Cookies on your Device in order to perform the services we hire them for. For example, Google and YouTube may set Cookies on your Device to enable them to gather usage analytics and interaction on the Website and video content.

• Necessary / Essential Cookies: These Cookies are session Cookies. They are administered by the Company, and they are essential to provide you with the Services available through the Website and App. They help to authenticate users and prevent fraudulent use of the Accounts. Without these Cookies, the Services that you have asked for cannot be provided, and we only use these Cookies to provide you with those Services.

• Cookies Policy / Notice Acceptance Cookies. These are Persistent Cookies that are administered by the Company. These Cookies identify if users have accepted the use of Cookies on the Website.

• Functionality Cookies. These are Persistent Cookies that are administered by the Company: These Cookies allow us to remember the choices you make when you use the Website and App, such as remembering your login details or language preference. The purpose of these Cookies is to provide you with a more personal experience and to avoid you having to re-enter your preferences every time you use the Website and App.

We use Cookies majorly for the purposes set out below:

• To operate the Website and App and host its content;

• To analyze our Service, including by gathering analytics and understanding how users use our Service;

• To monitor violations of our Terms and Conditions; and

• To enable us to monitor the views on our content. 

You have the right to reject, block or delete Cookies at any time. You can reject, block or delete Cookies at any time by using the Help, Settings or Tools section of the applicable Device browser. However, be aware that if you block any Cookie, the function it performs may immediately cease, which may alter your experience.

Third-party software

We use Google Analytics, a third-party analytics gathering tool, that allows us to gather Usage Data. Google Analytics enables us to generate leads by tracking individuals who click on our adverts on third-party platforms. We then use this Data to identify how our marketing campaigns are doing. Please, note that the Usage Data collected does not reveal Personal Data, such as your name, email address or photo. The data collected is anonymous. 

Our use of Personal Data

The Company may use the data collected from you for the following purposes:

• To provide and maintain our Service, including to allow you manage your work, create work documents, schedule tasks, interact with your employees and clients and perform other actions that are available through the App. 

• To manage your Account, including managing your registration as a user of the Service. The Personal Data you provide can give you access to different functionalities of the Service that are available to you as a registered user.

• To process your subscription: We will use the payment method information you submit to us via the App to process your subscription for our Service. Note that your payment method information is merely used by our payment processing Service Provider to process your subscription. They do not use it for any other purposes. 

• For the performance of a contract, including for the development, compliance and undertaking of the purchase contract for the Services you have purchased or of any other contract with us through the Service.

• To contact you and provide support services, including to contact you with administrative notices, such as changes to our Service or this Privacy Policy, and to respond to your questions, queries, complaints and enquiries via email, telephone calls, SMS, or other equivalent forms of electronic communication. 

• To send marketing messages, including sending you news about offers and information about offers on products and services we think match your interest via your email address, SMS or the App’s push notification. 

• For business transfers: We may use your data to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Data held by us about our Service users is among the assets transferred.

• To enforce our agreements and comply with laws: We may collect Device Data monitor violations of our agreements and enforce our rights in the event you breach them. We may also collect your data, such as details about your subscription, to comply with applicable laws and legal obligations (for example, where we are required as an entity to keep records). 

• For other purposes: We may use your data for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and evaluating and improving our Service, products, marketing and your experience.

Our sharing of Personal Data

We do not share your data without your consent. We may only share Personal Data in the following situations:

• With Service Providers: We may share your Personal Data with Service Providers to perform the service we hire them for (for example, we will share your PayPal email address with PayPal to enable them to process your payments). 

• For business transfers: We may share or transfer Personal Data about you in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of our business to another company.

• With Affiliates: We may share your data with our affiliates, in which case we will require those affiliates to honour this Privacy Policy. Affiliates include our parent company and any other subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

• With other users: When you interact with your team and clients through the App, your data will be visible to them.  

• With employees: Authorized employees may access Personal Data about you in circumstances where such access is needed to enable them to provide you with your request (for example, our support employee may access your data to provide support services to you). 

• With law enforcement and under other legal requirements: We may disclose Personal Data to the government and law enforcement agencies upon their request. This may be in response to lawful requests, such as court orders, subpoenas, and other legal summonses. The Company may also disclose Personal Data in the good faith belief that such action is necessary to: (i) comply with a legal obligation, (ii) protect and defend the rights and property of the Company or those of other users or third parties, (iii) prevent or investigate possible wrongdoing in connection with our Service, and (iv) protect against legal liability.

• With your consent: We may disclose Personal Data for any other purpose with your consent.

How we market with your data

Marketing emails

When you submit your data on the Website, you are subscribing to receive marketing notices about the App and other products from us. We will send marketing notices to your email address for as long as you are subscribed. If you wish to unsubscribe from receiving marketing notices from us, you can use the unsubscribing instructions provided at the bottom of any email you receive from us. 

Please, note that when you unsubscribe from receiving marketing emails, it does not apply to administrative messages, such as changes to our Service or updates regarding your account. 

Personalised or targeted advertising

The data we collect through the third-party software and tools above is shared with third-party marketing agencies (such as Facebook, Instagram and Google) which they then use to launch adverts that target you and individuals with matching preferences. 

You can opt out of personalised or targeted advertising on the applicable third-party platform. You can also learn more about personalised adverts here. 

The retention of Personal Data

The Company will retain Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

The cross-border transfer of your data

Your information, including Personal Data, is processed at the Company’s operating offices in Australia and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other information.

The security of your data

The security of Personal Data is important to us. We operate the Website and App on secure servers and limit the way we share Personal Data, including within the Company. However, you are aware that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect Personal Data from unauthorized access, use or alteration, we cannot guarantee its absolute security.

Your rights and choices 

With respect to the Personal Data you submit to us, you have certain rights and choices. These rights and choices are in addition to any other rights described in this Privacy Policy. They include: 

• The right to access and correct your data: You may request access to and correct any Personal Data about you, including data submitted when you create an account on the App, by using the “Account Info” section on the App. You may also reach out to us by clicking “Support” on the Website.

• The right to delete your data: You may reach out to us to have your data deleted from our Service. This data may include your email address, name and other data you submit to us via the Website or App. Please, use the “Delete Account” button on the App or contact us via “Support” on the Website.

• The right to withdraw your consent and permissions: Where you have given us consent to use your data, you may withdraw your consent at any time. Likewise, you may, at any time, withdraw the permissions you have given us. For example, you may restrict us from accessing your Device gallery by using the settings area of the applicable Device. However, be aware that withdrawing your consent and permissions automatically limits your ability to use certain features on the App. 

Children’s Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect Personal Data from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers. If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we may require your parent’s consent before we collect and use that information.

Links to other Websites

Our Service may contain links to other websites, apps and services that are not operated by us. If you click on a third-party link, you will be directed to that third party’s website, app or service. We strongly advise you to review the privacy policy of every website, app or service you visit to learn about their privacy practices. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party websites, apps or services.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “Last Updated” date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
